I'm a VP at the Pa Medical Society. We are studying the issue of directed referrals and will hopefully soon offer a guide on this issue. The quick answer is, "It depends."

Hospitals are using all possible means, some of them unethical to put independent private practitioners out of business. The administrators tell the employed physicians not to refer patients to private specialists,as their bonus depends on their referal pattern and how much money they generate. Is this legal when it involves medicare and medicaid patients? I hope some one addresses this which has changed the playing field to the sole advantage of hospitals.
